HIPAA act underwent major changes that have since then improved healthy information security. Some of the changes that have taken place include changing a rule that did not mandate use of a particular technical system to a HITECHI Act that makes it a degree (HIPAA). The law also requires a notification to be sent to all individuals of any unsecured health information. This is made within 60 calendar days failure to which disclosure of the information is regarded as unlawful. This notification breach is a necessity of every healthy facility of business. The HITECH act also included limited information that is disclosed to and to specific people or organization.
However, there is some information that is never disclosed and when disclosed, the organization takes responsibility over that. These include treatment, healthcare operations and payment. The law also requires disclosure of such information to a body that is mandated to take responsibility over payment of health care or the body that intends to carry out treatment. This is to mean that if the patient is responsible for paying his or her own bills, the information should not be disclosed to the insurance or any third party. Covered entities have to agree before the information is disclosed. The HITACHI law also bars receiving payments in exchange of protected information (Health Information Privacy). This is allowed only under special cases, which include for research purposes and treatment. A patient has a right to have access to electronic his or her information. Strict regulations have been implemented to inhibit the use of patient information for marketing purposes. Apart from the laws enacted by the HITACHI, the organization also created an enforcement that requires the people or organizations that have violated the law to be fined according to the extent which the laws have been violated. This is revealed by the audit authority that inspects the organizations to ensure that they obey the security rules (Health Information Privacy).
Some of the sections that require special attention include contacts of both the accused and the accuser, and a clear description of the violated law or the act committed. This will help in the follow up activities to ensure justice is administered. Failure to provide this information will lead to insufficient information, creating difficulty in investigations. This can also lead to discarding of the case. The organization or people who have committed the crime may be left to freely commit more crime while the patient remains devastated (Health Information Privacy).
