The police officers of Suffolk County lawfully detained Bailey. Bailey was suspected of having and distributing cocaine, because the informant told his address to the police officer. Having seen Bailey together with his partner leaving the house (the house was located in the street that was mentioned by the informant), the police officer detained Bailey in order to support or refute their suspicion. It was quite a lawful action, because Bailey posed a threat to society. More than that, it is unlawful to keep or distribute drugs, the punishment for which is imprisonment. In order to check the information and prevent people from a negative influence caused by the actions of Bailey, the police officers detained him. While Bailey was detained, the police officers of Suffolk County received a search warrant and found drugs and a gun there. “The police searched the apartment while Bailey and Middleton were in detention, finding a gun and drugs in plain view” (www.oyez.org). Later on, it was found out that one of Bailey’s keys was suitable to the door of that house.As a matter of fact, it was lawful to detain Bailey, because he was suspected of unlawful actions. However, it was unlawful to arrest him, because his guilt was not proven. First of all, the police officers must have had witnesses when conducting a search in Bailey’s house that would prove that that was his drugs. The police officer must have conducted an inquiry that would prove that drugs belonged to him. Only based on the results of the inquiry, Bailey must have been judged. As such inquiry was not conducted, the arrest is considered to be unlawful.To conclude, it is worth mentioning that the detention was lawful, but Bailey’s arrest was unlawful.
